Sending a notice
Your notice must include:
- your physical or electronic signature;
- the copyrighted work you say is infringed (or a list, if several);
- the material you say infringes, with enough detail for us to find it (for example a link, a shared study set, or a class post);
- your name, postal address, phone number, and email;
- a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and
- a statement that the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.
Most content in BrainBoost is private to the person who made it (chats, study sets, documents saved on the device). We can act on content stored on or shared through our service, such as shared study sets, class posts, class files, and generated images. Knowingly false notices can lead to liability for damages under 17 U.S.C. § 512(f).
Counter-notice
If your content was removed and you believe that was a mistake or misidentification, you can send a counter-notice to the same address with: your signature; the material removed and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address, and phone number; and a statement that you consent to the jurisdiction of the federal district court for your address (or, outside the U.S., any judicial district where BrainBoost may be found) and will accept service from the person who sent the original notice. We may restore the material in 10 to 14 business days unless the complainant tells us they have filed a court action.
Repeat infringers
We disable accounts of users who repeatedly infringe, in appropriate circumstances.
